Parental leave, governed by Legislative Decree 151/2001 (Consolidated Act on Maternity and Paternity), allows parents to take time off work to care for their children in the early years. As with Law 104 leave, this benefit is intended for a specific care function. Using leave for activities entirely unrelated to this function may constitute an abuse of rights and justify disciplinary action. Ponzi Intelligence conducts discreet, documented checks.
Legislative Decree 151/2001 (Articles 32-38) governs parental leave. The Supreme Court has extended by analogy the principles developed for Law 104 leave abuse to parental leave: use for purposes entirely unrelated to childcare violates the duties of good faith. The employer may legitimately engage private investigators to verify proper use, provided the investigations respect privacy and family dignity.
