Article 8 of the Workers’ Statute prohibits employers from investigating a candidate’s political, religious or trade union views. Checks may cover the accuracy of the CV, professional references, employment history and consistency of information provided. The Data Protection Authority has clarified that processing personal data in the pre-employment context is lawful if based on the employer’s legitimate interest (Art. 6.1.f GDPR) and limited to what is necessary.
